The Maine OUI Handbook is a reference book designed specifically for the state of Maine, revised October 2018. It is not a how-to or a trial technique book.† It is primarily an attempt to pull together, in one place, citations to and summaries of cases, statutes and rules that are important to issues commonly encountered in OUI practice.This is the fourth edition of Maine OUI Law that was developed 9 years ago. The book started as a project to pull together, in one place, case citations and summaries, statutes and rules bearing on issues Maine lawyers commonly come across in OUI practice. The book deals with these issues in the order that lawyers typically encounter them. The current edition incorporates statutory changes and significant Maine and U.S. Supreme Court cases decided since publication of the 2016 edition. Statutory references are current through legislation passed by the Second Regular Session of the 128th Maine Legislature, effective August 1, 2018. References to the Code of Maine Rules are current as of August 1, 2018. I hope everyone who uses the book will take something useful from it, and I welcome feedback to assist with improvements.
